Terms of Service

These Terms of Service ("Terms") are an agreement between you and DragBuilder ("DragBuilder", "we", "us") that governs your use of the DragBuilder website, web app and desktop applications (the "Service"). By creating an account or using the Service you agree to these Terms. If you use the Service for an organization, you confirm that you can accept these Terms on its behalf.

1. The Service

DragBuilder is a visual builder that lets you design applications by dragging and dropping, generates the source code for them, and can build and publish them on your behalf. Features may change, and some are provided in beta. We may add, modify or remove features, and we will try to give notice of material changes.

2. Your account

• You must be at least 16 years old and able to form a binding contract.
• You sign in through a third-party provider (Google, Apple, GitHub or Microsoft). You are responsible for the security of that account and for everything done through your DragBuilder account.
• Provide accurate information and tell us promptly if you suspect unauthorized access.

3. Your content and the apps you build

You keep all rights to your projects, assets and the apps you create ("Your Content"). You grant us a limited license to host, process, copy and transmit Your Content only as needed to operate the Service for you: for example to store your projects, generate code, run builds and publish them when you ask. You can export your project and its source code at any time.

You are responsible for Your Content and for the apps you publish: you confirm that you have the rights to everything you upload and that your apps comply with the law and with the rules of the stores where you publish them (such as Google Play and the App Store).

4. Publishing, store accounts and signing keys

• Publishing to Google Play or the App Store requires your own developer accounts and credentials. Store approval, listing and policy compliance are your responsibility and are outside our control.
• Google Play requires the first release of a new app to be uploaded by hand in the Play Console; DragBuilder can generate the signed bundle for that purpose.
• We generate an Android signing key for each project. The key identifies your app to the store: if you lose it you may be unable to update your app. Download and store a safe copy of your keystore and its passwords; we cannot recreate the same key for you.
• You authorize us to use the credentials you provide solely to build, sign and publish your apps at your request.

5. Acceptable use

You agree not to:

• break the law, infringe the rights of others, or build apps that are malicious, deceptive or harmful;
• upload malware, or attempt to gain unauthorized access to the Service, other accounts or our infrastructure;
• interfere with or overload the Service, or circumvent usage limits or security measures;
• resell or provide the Service to third parties as a competing product, or use it to train competing models;
• use the AI features to generate unlawful content or to violate the AI provider's usage policies.

We may suspend or restrict accounts that violate these rules, with notice where reasonably possible.

6. Plans, payments and cancellation

Some features require a paid subscription. Prices, plans and billing periods are shown at checkout. Payments are processed by Paddle, our merchant of record, and may be subject to its terms and applicable taxes. Subscriptions renew automatically until canceled. You can cancel at any time from your account; access continues until the end of the paid period. You can ask for a refund within 14 days of any payment, as described in ourRefund Policy; after that, fees already paid are non-refundable except where required by law. We may change prices with advance notice before your next renewal.

7. Our intellectual property

The Service, including its software, design, components and branding, belongs to DragBuilder and its licensors. These Terms do not give you any right to them other than the right to use the Service as described here. The code generated for your apps is yours, subject to any open-source licenses of the libraries it includes.

8. Third-party services

The Service works with third-party services (cloud hosting, build, payment, email, analytics and AI providers, and the app stores). Your use of those services may be governed by their own terms, and we are not responsible for them.

9. Availability and changes

We work to keep the Service available but do not guarantee uninterrupted or error-free operation. We may perform maintenance and may discontinue the Service or a feature, giving reasonable notice and a way to export Your Content where possible.

10. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the extent permitted by law. AI-generated output may be inaccurate; review it before you rely on it or publish it.

11. Limitation of liability

To the extent permitted by law, DragBuilder will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if required by law. On termination your right to use the Service ends; sections that by their nature should survive (such as ownership, disclaimers and liability) will survive.

13. Changes to these Terms

We may update these Terms. We will post the new version with a new "Last updated" date and notify you of material changes by email or within the app. If you keep using the Service after the changes take effect, you accept them.
